SUBJECT: River Oaks ''Tree Plan,'' ORIGINAL (10/30/2012) - AMENDMENT (09/09/14)
Be advised that any changes in external appearance of buildings (e.g. roofs or buildings) and physical features of the property (e.g. trees, earthworks, walks, driveways, fences, driveway markers, etc.) must be approved in advance by the Architectural Control Committee (ACC).
Property owners with diseased or damaged trees must notify the ACC through a request to remove the tree. Property Owners may present their preference for dealing with the situation, but the ACC has final authority for the resolution which shall not be unreasonably withheld. All trees that are approved to be removed must be replaced with similar type trees. Property Owners will be fined for making changes not approved by the ACC. Trees contribute to the natural beauty of the Development. Unauthorized removal of trees in excess of 4 inches trunk diameter will result in fines starting at $500 per tree and increasing to $2000 per tree depending on the diameter and number of trees cut down. Actual assessments will be determined by the ACC upon each occurrence.
Because of the unique type of maintenance requirements associated with Bradford Pear Trees and their similarities to shrubs in this respect, they should be treated as a shrub and may be trimmed by the homeowner accordingly. Bradford Pear Trees may present quite a liability when not maintained properly.
The authority of the ACC is cited in the Thunder Hollow Covenants and Restrictions. These Covenants and Restrictions, which apply to all Property Owners in the Development, state that the ACC can change its requirements and assessments as circumstances appear appropriate. Please read carefully these documents:
• ''Declaration of Covenants and Restrictions Thunder Hollow Development''
• The covenants and restrictions which apply to each of the particular subdivisions in which you own or expect to own property.
• The ''Reguirements for Building a New Home or Changing the Exterior of an Existing Home at River Oaks.''
Current or Prospective Property Qwners are responsible for obtaining and understanding these documents. Ignorance of them will not void a Property Owner's obligation to pay any fines assessed by the ACC.
All Property Owners have a strong interest in observing ACC requirements because they are directed toward preserving a beautiful Development. This leads to enhanced property values for everyone.
